ELIGIBILITY:
You must be 21 years or older to purchase a raffle entry. Purchasers of raffle tickets must qualify under Texas Law. All federal, state and local laws and regulations apply. Raffle tickets are non-transferable and non-refundable;all ticket sales are final. The following individuals and their immediate family members residing in the same household are not eligible to participate in this raffle: a) Mission Road Ministries’ Staff.
RAFFLE TICKET PURCHASES:
Mission Road Ministries and its agents, Board, volunteers, partners, employees or members assume no liability for lost, late, misdirected, mutilated, illegible,undelivered entries. Entries received without proper payment will be deemed invalid and shall be immediately disqualified.
DRAWINGS:
A maximum of 150 tickets will be sold for this raffle.Ticket prices are 1 ticket for One Hundred and No/100 Dollars ($100.00). The Grand Prize Draw Date is Thursday, December 3, 2009 at 10:15 P.M. (CST) (the“Draw Date”). Tickets can be purchased until 9:45 P.M. (CST) December 3, 2009or until tickets are sold out, whichever comes first. All purchases of tickets are non-refundable. In this raffle only one ticket will win and there is no possibility of a tie. All references to time apply to Central Standard Time only.
ODDS:
A maximum of 150 tickets will be sold. The chances of winning are based upon the number of tickets actually sold.
GRAND PRIZE:
The winner of the Grand Prize will have twenty-one (21)calendar days from the Draw Date to claim their prize from Mission Road Ministries (8706 Mission Road, San Antonio, Texas 78214). The value of such Rolex may not exceed the amount of $10,750.00 MSRP. Proceeds from the raffle will be used to benefit the children and adults of Mission Road Ministries. There will be no cash/change or refunds offered to winner for the actual value of the Rolex. The winner will be solely responsible for personal income taxes, if any, generated because of his/her winning this raffle.
NOTIFICATION OF WINNERS:
Winner need not be present to win. Winner will be notified in writing via Registered Mail of requisite procedure to claim prize. Winner’s name will be posted at www.shindig.missionroadministries.org within 4 calendar days of the drawing. Winning entrant may have up to twenty-one (21) calendar days of Draw Date to finalize the process of claiming the Grand Prize (including payment of taxes, withholding, etc). Winning entrants’ name and location by city or town and photo may be printed in select media and at www.missionroadministries.org.If selected winning entrant is unable to be contacted or located after a period of six (6) months from the Draw Date, the prize will be donated to Mission Road Ministries. Three (3) attempts will be made to contact the winning entrant via Registered Mail at the address provided by the entry purchaser.
TAXES AND IRS RULES:
Winner is responsible for any and all federal, state and local income or excise taxes, fees, assessments and like charges associated with the prize. Winner will be responsible for retrieval of their prize. Winner will be required to pay a withholding percentage (25%) of the fair market value of the Rolex prior to taking possession of the prize, to comply with the IRS for Federal and State with holding requirements. This is to comply with the IRS ruling that requires that tax withholding on prizes of $5,000.00 or greater must be paid upon award and distribution by the organization hosting the raffle. The value of your winnings is considered taxable income. Please consult your financial adviser to discuss any impact on your personal taxable income.Government rules regarding withholding can change without notice. The Mission Road Shindig 2009 Rolex Raffle will follow IRS rules in effect at the time the prizes are awarded.
WAIVER/LIMITATIONS OF LIABILITY:
Entrants, by participating (and winners by accepting the prize) release Mission Road Ministries and Moretti’s Fine Jewelry and their respective agents, Board, volunteers, partners,employees, members, service agencies, and independent contractors and each of their respective directors, officers, partners, employees and agents, including advertising and promotion agencies, from any and all liability with respect to participation in the promotion and possession or use of the prize awarded.Entrants will not hold Mission Road Ministries and/or Moretti’s Fine Jewelry responsible or liable for any or all accidents, theft or damages resulting by their participation in this event. By purchasing a ticket, the entrant acknowledges and agrees to be bound by these rules and regulations.
RELEASE:
Entrants, by participating, agree to allow Mission Road Ministries to use their names, photos and statements in promotional material. Mission Road Ministries will not share other personal information from entries with other organizations.
